Labor law procedures consist of monitoring the work of an employee from concluding the contract of employment to terminating it (when the employee leaves the company). Labor law procedures primarily include:

  • Evaluating the employee during probation period
  • Measuring productivity and awarding
  • Intensive monitoring of the employees' work when expected results are not being reached (performance improvement)
  • Employee's disciplinary responsibilities and liability for damages
  • Ordinary termination of employment procedure due to business reasons/incompetence/misconduct/inability to perform (physical disability)
  • Extraordinary termination of employment procedure and other types of termination defined by law

Labor law procedures are important for the employee as well as for the employer. Labor law legislation protects the worker against illegal conduct of the employer. The employer's responsibility is to respect the relevant laws and avoid sustaining unnecessary damage due to ignorance. On the other hand, the employee must act responsibly during the working relation, carry out his/her duties and obligations, act in accordance with the internal rules of the company, follow the instructions of the superiors and strive to perform at his/her best.

In case an employee violates his/her work obligations or does not reach the minimal standards (i.e. expected results) expected of him/her, the employer has the legal right to take action. Unfortunately, employers are too frequently unaware of the labor law procedures, trying to avoid unpleasant situations and not wanting to deal with such employees in the necessary extent. The consequence of such passiveness is that the employee continues to fail to bring any added value or even cause potential harm to the company.

Incorrectly carried out labor law procedures can take up a lot of employer's time and cause great damage especially if a termination of employment is illegal and the employer must offer the employee his/her job back.
